1. Identification and Framework
The Observatório Astronómico de Travancinha is a private non-profit association, which promotes astronomical, educational, scientific and tourist experiences in the parish of Travancinha, municipality of Seia, Portugal.
Its activity is governed by applicable Portuguese legislation, including the Civil Code, Law No. 24/96 (Consumer Protection Law), other regulations applicable to the provision of services and Regulation (EU) 2016/679 (GDPR).
2. Purpose
These Terms and Conditions govern participation in the experiences promoted by the association, including reservations, payments, cancellations, liability and participants' rights.
Registration or participation implies full acceptance of these terms.
3. Nature of Experiences
Activities may include:
- Guided interpretation of the night sky
- Astronomical observation with telescopes
- Experiential outdoor activities
- Educational and scientific sessions
Experiences take place mostly in a natural environment and depend on suitable weather conditions.
4. Reservations
4.1. All experiences require prior reservation.
4.2. The reservation is considered valid after formal confirmation from the association.
4.3. The association may limit the number of participants to ensure quality, safety and the exclusive nature of the experience.
5. Payments
5.1. Prices are communicated at the time of reservation and include VAT at the legal rate in force, when applicable.
5.2. Full or partial advance payment may be requested to confirm the booking.
5.3. Non-payment within the established deadline may result in cancellation of the reservation.
6. Cancellations and Weather Conditions
6.1. Activities depend on favorable atmospheric conditions.
6.2. In case of adverse conditions, the association may:
- Reschedule the session;
- Adapt the format of the experience;
- Proceed with a refund, when applicable.
6.3. Under the terms of Decree-Law No. 24/2014, the right of free termination may not apply to leisure activities with a specific date.
7. Private Groups and Exclusive Events
7.1. The association may organize private sessions for groups, companies, retreats or exclusive events.
7.2. In these cases, specific conditions may apply previously agreed in writing, namely:
- Differentiated cancellation policy;
- Full advance payment;
- Specific logistical conditions;
- Personalized schedules.
7.3. Confirmation of the event implies acceptance of the agreed conditions.
8. Activities with Minors
8.1. The participation of minors requires express authorization from their legal representative.
8.2. The association may request a signed liability statement.
8.3. Minors must be accompanied by a responsible adult, except in activities specifically organized for school groups with institutional supervision.
8.4. The association acts with diligence and care, but does not replace parental or institutional responsibility.
9. Safety and Liability
9.1. Activities take place in a natural environment and may involve movement on uneven terrain.
9.2. Appropriate clothing and footwear are recommended.
9.3. The association is committed to acting with professionalism and diligence.
9.4. However, it cannot be held responsible for:
- Weather changes;
- Force majeure situations;
- Negligent behavior of participants;
- Loss or damage to personal belongings.
9.5. Civil liability is limited to legally provided terms.
10. Use of Image (Photography and Video)
10.1. During activities, photographic images or videos may be captured for institutional and promotional purposes of the association.
10.2. Participation in activities implies consent for the use of images, unless expressly stated otherwise in writing before the start of the session.
10.3. In the case of minors, authorization must be granted by their legal representative.
10.4. Images will not be used for commercial purposes outside the institutional activity of the association.
11. Personal Data Protection
11.1. The processing of personal data is carried out in accordance with GDPR and applicable national legislation.
11.2. The data collected is exclusively intended for reservation management, communication with participants and compliance with legal obligations.
11.3. Data subjects may exercise their rights through formal contact with the association.
12. Sustainability
The association promotes responsible and sustainable practices, encouraging respect for the region, nature and the preservation of the night sky of Serra da Estrela.
13. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Portuguese law.
In case of dispute, the territorially applicable court shall have jurisdiction, without prejudice to the use of alternative consumer dispute resolution mechanisms.
